1. Who We Are

The Services are provided by:

References to “Deltaxis”, “we”, “us”, or “our” mean this provider.

2. Worldwide Service

The Services are offered to users globally, subject to these Terms, our Privacy Policy, and applicable law. You are responsible for ensuring that your use of the Services is lawful in your country of residence.

Nothing in these Terms limits mandatory consumer rights that apply to you under the laws of your country of habitual residence.

3. Eligibility

To use the Services, you must:

• be at least 18 years old;
• have the legal capacity to enter into a binding contract;
• not be prohibited from using the Services under applicable law;
• provide accurate and current registration information;
• understand the risks described in Section 12.

The Services are intended for personal or internal business use. You may not use the Services on behalf of third parties as a regulated financial service unless you hold all required licences.

4. Description of the Services

Deltaxis provides a cryptocurrency market screening platform that may include, depending on your plan:

• screening of USDT perpetual futures pairs and related market data;
• technical indicators and charting tools;
• saved filters, favorites, and chart preferences;
• subscription-based access to advanced features.

Feature availability depends on your subscription tier. Current plan features and limits are described on the My Plan page within the Platform and may be updated from time to time.

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, provided that we will not materially reduce paid features during an active prepaid period without a remedy or refund proportionate to the unused period, where required by law.

5. Account Registration and Security

• You must register an account with a valid email address and password.
• You are responsible for all activity under your account and for keeping your credentials confidential.
• Notify us immediately at contact@deltaxis.com if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms or pose a security risk.
• One account per individual unless we expressly authorize otherwise.

6. Subscription Plans and Pricing

6.1 Plans

Deltaxis offers the following tiers:

• Starter — free, limited features;
• Pro — paid subscription, expanded features;
• Elite — paid subscription, full feature access.

6.2 Pricing and currency

Paid subscriptions are processed through Stripe and priced in US Dollars (USD). Depending on your location, Stripe may offer you the choice of paying in your local currency instead, at the exchange rate applied by Stripe at that time. Where offered, the choice is yours.

The currency and the exact amount charged are shown at checkout before you confirm your purchase. That displayed amount is the amount you agree to pay. Your bank or card issuer may additionally apply its own conversion or cross-border fees, over which we have no control.

Prices, billing intervals (monthly or annual), and promotional rates (including early-adopter pricing) are displayed on the Platform at the time of purchase.

Promotional pricing may be limited in time or availability. We may change standard prices for future billing periods by giving you reasonable advance notice; price changes apply from your next renewal unless otherwise stated or required by law.

6.3 Taxes

Prices may exclude applicable taxes (e.g. VAT, GST, sales tax). Where required by law, taxes will be added at checkout or on your invoice.

6.4 No financial services

Subscription fees grant access to software tools only. They do not constitute investment management fees, trading commissions, or payments for financial advice.

7. Payment and Billing

• Payments are processed by Stripe, Inc. or its affiliates. We do not store full payment card details.
• By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
• You may be required to provide a billing address at checkout.
• If payment fails, we may suspend paid features after a reasonable grace period and notify you.
• Upgrades may take effect immediately; downgrades typically take effect at the end of the current billing period unless otherwise shown in the Stripe customer portal or checkout flow.

8. Cancellation, Refunds, and Consumer Rights

8.1 Cancellation

You may cancel your paid subscription at any time through the Stripe Customer Portal (My Plan / billing section) or by contacting contact@deltaxis.com.

Cancellation stops future renewals. You generally keep access until the end of the current billing period, then revert to the Starter plan. Cancelling does not by itself entitle you to a refund for the current or any previous billing period.

8.2 Refunds — applicable law

Refund eligibility is determined by mandatory consumer protection laws applicable to you, including based on your country of habitual residence and/or the billing address provided at checkout, whichever grants you stronger non-waivable rights.

Where the law entitles you to withdraw from a distance contract or to receive a refund within a statutory period, we will honour such requests in accordance with that law. We do not guarantee any specific refund period beyond what applicable law requires.

Renewals: Statutory withdrawal and refund rights, where they exist, apply to the initial subscription purchase in principle, not to automatic renewals of an existing subscription. You may cancel before the next renewal date to avoid future charges.

Outside mandatory legal obligations, all fees are non-refundable, including partial periods and unused time.

8.3 How to request a refund

Contact contact@deltaxis.com from your registered email, stating your account email, subscription date, and reason for the request. We will respond within a reasonable time and indicate whether your request is granted under applicable law or our policies.

If you believe you were charged in error (duplicate charge, wrong amount), contact us promptly with details of the transaction.

8.4 Abuse and misuse

We reserve the right to decline refund requests where we reasonably believe the request is abusive, fraudulent, or inconsistent with good faith use of the Services, including but not limited to:

• repeated subscribe–refund–resubscribe patterns intended to obtain free access;
• substantial use of paid features followed by systematic refund requests;
• multiple accounts or identities used to circumvent subscription limits or refund policies;
• chargeback abuse or false claims.

Declining a refund on abuse grounds does not affect your mandatory statutory rights where applicable law requires a refund regardless of our assessment. We may suspend or terminate accounts involved in abuse.

8.5 Goodwill refunds

We may, at our sole discretion, offer a refund or partial refund in situations not covered by law. Such gestures do not create an obligation for future requests and do not modify these Terms.

9. Acceptable Use

You agree not to:

• use the Services for unlawful purposes or in violation of applicable financial, export, or sanctions laws;
• scrape, crawl, reverse engineer, decompile, or attempt to extract source code or underlying data models, except as permitted by mandatory law;
• circumvent subscription tiers, access controls, rate limits, or authentication;
• resell, sublicense, or provide the Services to third parties without our written consent;
• transmit malware, interfere with infrastructure, or conduct denial-of-service attacks;
• use the Services to provide regulated investment advice or managed trading to third parties without proper licensing;
• impersonate others or provide false registration information.

We may investigate violations and cooperate with law enforcement where required.

10. Intellectual Property

The Services, including software, design, logos, text, algorithms, and compilations of data and indicators, are owned by Deltaxis roch or its licensors and protected by intellectual property laws.

Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal or internal business purposes.

You retain ownership of content you create (e.g. chart drawings, filter configurations). You grant us a licence to store and process that content solely to provide the Services.

“Deltaxis” and related marks are our trademarks. You may not use them without prior written permission.

11. Third-Party Data and Services

Market data may be sourced from third parties (including public exchange data feeds such as Binance). We are not affiliated with, endorsed by, or sponsored by any cryptocurrency exchange unless expressly stated.

Third-party data may be delayed, incomplete, or inaccurate. We do not guarantee the accuracy, timeliness, or availability of market data or indicators.

Stripe, AWS, and other providers are subject to their own terms. Your use of those services in connection with billing or authentication is also governed by their policies.

12. Investment and Risk Disclaimer

READ THIS SECTION CAREFULLY BEFORE USING THE SERVICES.

12.1 Not financial, investment, or trading advice

Deltaxis is a software tool for cryptocurrency market screening, technical analysis, and charting. It is provided for informational and educational purposes only.

Deltaxis does not:

• provide investment advice, financial planning, or portfolio management;
• recommend that you buy, sell, or hold any cryptocurrency, token, derivative, or financial instrument;
• execute trades on your behalf or access your exchange accounts or wallets;
• assess your personal financial situation, objectives, or risk tolerance.

Nothing on the Platform — including screening results, technical indicators, signals, scores, alerts, or chart overlays — constitutes a personalised recommendation or an offer, solicitation, or invitation to enter into any transaction.

Deltaxis roch is not a bank, broker, dealer, exchange, investment adviser, or asset manager. We are not regulated by FINMA (Swiss Financial Market Supervisory Authority) or any other financial regulator for the provision of investment services.

12.2 Your sole responsibility

All trading and investment decisions are made entirely at your own risk and discretion. You are solely responsible for:

• evaluating the merits and risks of any trade or investment;
• determining whether a product or strategy is suitable for you;
• complying with laws and regulations applicable in your jurisdiction;
• paying any taxes, duties, or reporting obligations arising from your activities;
• securing your exchange accounts, wallets, and credentials.

You should consult a qualified, independent financial, legal, or tax professional before making financial decisions. Do not rely on Deltaxis as a substitute for professional advice.

12.3 Cryptocurrency and derivatives risks

Cryptocurrency markets, including USDT-margined perpetual futures and other derivatives, involve substantial risk of loss, including the possible loss of your entire invested capital.

Key risks include, without limitation:

• Volatility — prices can move sharply and unpredictably in short periods;
• Leverage — amplified gains and losses; liquidation of positions;
• Liquidity — inability to enter or exit positions at desired prices;
• Market manipulation — pump-and-dump, wash trading, spoofing in thin markets;
• Exchange and counterparty risk — insolvency, hacks, withdrawal freezes, delistings;
• Regulatory risk — changing laws may restrict trading or affect asset value;
• Technology risk — network outages, smart contract bugs, chain forks;
• Stablecoin risk — de-pegging or loss of reserve backing (e.g. USDT).

Never invest more than you can afford to lose. Cryptocurrency trading is not suitable for all investors.

12.4 Market data, indicators, and server-calculated values

Deltaxis displays market data sourced from third parties (including public exchange feeds such as Binance). Raw market data may be delayed, incomplete, or inaccurate, subject to interruptions or feed errors, and based on historical prices that do not predict future performance.

Indicator values, screening results, filter matches, rankings, signals, and related metrics are computed by Deltaxis servers from third-party market data. They are not provided directly by exchanges and are not verified by us for trading purposes.

These calculations may be incomplete, delayed, outdated, or incorrect due to, without limitation: feed interruptions or latency; missing candle history; software bugs; caching and scan refresh intervals; misconfiguration of indicators or filters; or discrepancies with your exchange’s live data.

Technical indicators are mathematical calculations, not predictive guarantees. Filter results reflect algorithmic conditions at a given moment and do not identify “good” or “safe” investments.

You must independently verify any value, signal, or screening output on your exchange or another authoritative source before acting on it.

12.5 No performance guarantees

• Past performance does not guarantee future results.
• Backtested or historical indicator behaviour may not repeat in live markets.
• We do not warrant the accuracy, timeliness, completeness, or availability of any data or feature.
• Platform uptime, scan speed, and feature availability may vary without notice.

Any examples, tutorials, or Academy content are for illustration and education only and must not be interpreted as trading instructions.

12.6 Delayed and live market conditions

Displayed data may be refreshed on a schedule and may differ materially from live trading conditions due to slippage, fees, funding rates, latency, and order-book depth. Always verify prices and conditions on your exchange before acting.

12.7 Regulatory and geographic restrictions

The Services are offered globally, but you are responsible for ensuring that your use of Deltaxis and any trading activity complies with laws in your country of residence.

Cryptocurrency derivatives trading is restricted or prohibited in certain jurisdictions. Deltaxis does not verify your eligibility to trade.

If you are unsure whether crypto trading is legal where you live, seek legal advice before using the Services or placing trades.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that data will be accurate or complete.

Where mandatory consumer law prohibits exclusion of warranties, those rights remain unaffected.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Deltaxis roch, its owner, contractors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, trading losses, or goodwill, arising from or related to your use of the Services.

Our total aggregate liability for any claims arising out of or relating to the Services or these Terms shall not exceed the greater of: (a) the amounts you paid to us in the 12 months preceding the claim, or (b) USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights in your jurisdiction. In particular, nothing in these Terms limits liability that may not be excluded in advance under article 100 of the Swiss Code of Obligations.

Trading losses: Without limiting the foregoing, we are not liable for any financial losses resulting from trading decisions you make based on the Services, including reliance on data, indicators, filter values, signals, or screening results described in Section 12.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Deltaxis roch from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or violation of third-party rights.

This section does not apply to consumers to the extent prohibited by mandatory consumer protection law.

16. Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

17. Suspension and Termination

We may suspend or terminate your access immediately if you:

• breach these Terms;
• fail to pay subscription fees;
• engage in fraud, abuse, or unlawful activity;
• create risk or harm to us, other users, or third parties.

You may stop using the Services at any time and cancel paid subscriptions as described in Section 8. Upon termination, your right to access the Services ends. Provisions that by nature should survive (including Sections 10–15 and 19) will survive termination.

18. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date indicates the current version. Material changes will be notified by email and/or a prominent notice on the Platform at least 30 days before they take effect, where required by law.

Continued use after the effective date constitutes acceptance of the updated Terms, except where applicable law requires your express consent. If you do not agree, you must stop using the Services and cancel your subscription.

19. Governing Law and Disputes

19.1 Governing law

These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

19.2 Consumers

If you are a consumer, you benefit from any mandatory provisions of the law of your country of habitual residence. Nothing in these Terms affects those non-waivable rights.

19.3 Jurisdiction

Subject to mandatory consumer law, the exclusive place of jurisdiction for disputes is the courts of Nyon, Canton of Vaud, Switzerland.

Consumers in the EU/EEA/UK may also bring proceedings in the courts of their place of residence where required by applicable law.

19.4 Informal resolution

Before initiating formal proceedings, please contact contact@deltaxis.com and allow us 30 days to attempt to resolve the dispute informally.

20. General Provisions

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Services.
• Severability: If any provision is invalid, the remainder remains in effect.
• No waiver: Failure to enforce a provision is not a waiver of that provision.
• Assignment: You may not assign your rights without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets (with notice where required).
• Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control (including outages, exchange failures, internet disruptions, or regulatory actions).
• Language: These Terms are drafted in English. Translations are for convenience only; the English version prevails to the extent permitted by law.
