IMPORTANT: Deltaxis is an analytical tool, not financial advice.

3. Eligibility

To use Deltaxis, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding contracts
  • Provide accurate, current, and complete information
  • Comply with all applicable local laws and regulations

4. Account Registration

  • You are responsible for maintaining the security of your account
  • Keep your password confidential and secure
  • One account per user (no account sharing)
  • Notify us immediately of any unauthorized access
  • You are responsible for all activities under your account

5. Subscription Plans and Pricing

Available Plans

Payment

6. Right of Withdrawal (EU/EEA Only)

EU/EEA consumers have 14 days to withdraw without reason.

How to Exercise Withdrawal Right:

  • Subject line: “Withdrawal”
  • Include: Name, email, subscription date

Refund Process:

  • Full refund if withdrawal within 14 days of purchase
  • Refund processed within 14 days
  • Refunded to original payment method

Waiver:

By immediately using the Service, you acknowledge that:

  • Service delivery begins before the 14-day period ends
  • You may lose the withdrawal right if service is fully consumed
  • Partial refunds may apply based on actual usage

7. Cancellation

Cancellation by You:

  • Cancel anytime via account settings
  • Access continues until end of current billing period
  • No refund for unused time (except EU withdrawal right)
  • Account data deleted per Privacy Policy

Cancellation by Us:

  • For violation of these Terms: Immediate termination, no refund
  • For service discontinuation: 90 days notice, pro-rata refund

8. Price Changes

  • We reserve the right to change subscription prices
  • 30 days advance notice for price changes
  • Existing subscriptions honored at current price until next renewal
  • You may cancel before new price takes effect

9. Taxes

Prices exclude applicable taxes including:

  • Swiss VAT (if applicable)
  • EU VAT (based on customer location)
  • US sales tax (based on customer location)
  • You are responsible for any local taxes or duties

10. Acceptable Use

You Agree NOT To:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Attempt to breach security measures
  • Use automated systems (bots, scrapers) without written permission
  • Resell, redistribute, or sublicense our data or service
  • Reverse engineer the platform
  • Create false or misleading accounts
  • Interfere with platform functionality
  • Use the service for illegal trading activities

11. Intellectual Property

  • All Deltaxis platform content, algorithms, and data are our property
  • You are granted a limited, non-exclusive, non-transferable license for personal use only
  • You may not copy, modify, distribute, or create derivative works
  • Deltaxis trademarks and logos are protected

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Total liability is limited to: Subscription fees paid in the 12 months prior to the claim.

Exception: Mandatory liability under Swiss law that cannot be excluded.

15. Indemnification

You agree to indemnify and hold harmless Deltaxis, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Violation of any third-party rights
  • Trading decisions made using our platform

16. Service Modifications and Availability

We reserve the right to:

  • Modify or discontinue features with notice
  • Perform scheduled maintenance (announced 48 hours in advance)
  • Suspend service temporarily for updates or repairs
  • Change data sources or indicators

We are not liable for any modification, suspension, or discontinuation of the Service.

17. Term and Termination

Subscription Term

  • Begins on payment confirmation
  • Continues until cancelled or terminated

Effect of Termination

  • Immediate loss of access to platform
  • Account data deleted per Privacy Policy
  • Outstanding payment obligations remain due
  • Survival of sections: Intellectual Property, Disclaimer, Limitation of Liability, Indemnification

18. Dispute Resolution

Governing Law

Governed by:

  • Swiss law (Canton of Vaud)
  • GDPR compliance for EU users
  • CCPA compliance for California users

Jurisdiction

  • Primary: Courts of Canton of Vaud, Switzerland
  • Exception: EU users may pursue claims in their country of residence

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

Continued use after changes constitutes acceptance of new Terms.
